Privacy Policy — LoveUP

LoveUP is a digital product of ONYX GLOBAL SERVICOS DE MARKETING E TECNOLOGIA LTDA, enrolled under CNPJ No. 63.810.320/0001-27, headquartered in São Paulo/SP, Brazil.

This Privacy Policy explains how LoveUP may collect, use, store, share, and protect personal data related to use of the app, website, digital features, subscriptions, and support channels.

LoveUP is in development and preparation for launch. Some features described in this Policy may be released gradually depending on version, platform, region, and plan.

1. Data controller

The controller responsible for personal data related to LoveUP is:

2. Data LoveUP may collect

Depending on the features used, LoveUP may collect or process account data, couple and interaction data, gamification and digital economy data, subscription and payment data, technical and device data, notifications, and, in future versions or optional features, photos, media, and user-submitted content.

  • name, email, user identifiers, authentication, and basic preferences;
  • couple link, shared progress, messages, LoveWinks, streaks/flame, badges, achievements, digital rewards, and relevant events;
  • LoveCoins, XP, rewards, limits, cycles, and action history needed for fair and secure operation;
  • subscription identifier, provider, plan, status, billing cycle, start and end dates, cancellation, refund, or expiration when applicable;
  • device type, operating system, app version, language, technical identifiers, error logs, performance, usage, navigation, and security data.

LoveCoins, XP, badges, achievements, and digital rewards are internal LoveUP gamification resources. They do not represent money, electronic currency, cryptoassets, investments, bank balances, or redeemable monetary value.

Onyx Global does not store full credit card data. Payment information is processed by the respective payment providers according to their own terms and policies.

3. How LoveUP may use data

Data may be used to create and maintain accounts, authenticate access, connect partners, operate messages, LoveWinks, rewards, streaks, badges, progress and other features, release or restrict resources, process subscriptions, respond to support, send authorized notifications, improve stability, security and performance, prevent fraud, and comply with legal obligations.

4. Legal bases

Personal data may be processed under the LGPD, including contract performance, legal or regulatory obligations, legitimate interest, consent, regular exercise of rights, and fraud prevention and user security.

5. Data sharing

We may share data with providers needed to operate LoveUP, such as hosting, databases, authentication, payments and subscriptions, Apple, Google Play, Stripe or other providers, analytics, diagnostics, notifications, support, communication, security, monitoring, fraud prevention, and public authorities when legally required.

We do not sell personal data.

6. Data shared between partners

As an app for couples, some information may be visible to the linked partner, such as messages, replies, LoveWinks, shared progress, couple rewards or events, interaction status, achievements, or gamified elements visible in the app.

Users should use LoveUP responsibly, respectfully, and consciously, considering that certain actions are designed to be shared within the couple link.

7. Data retention

We will retain personal data for as long as necessary to operate the app, fulfill this Policy, meet legal obligations, resolve disputes, prevent fraud, maintain security, and preserve necessary records.

To protect user security, we may request additional information to confirm the requester's identity before processing the request. Some data may be retained when required for legal obligations, fraud prevention, security, audit, defense of rights, or minimum records required by law.

9. Security

We adopt reasonable technical and organizational measures to protect data against unauthorized access, loss, alteration, improper disclosure, fraud, or misuse. Even so, no system is entirely risk-free.

10. Children and teenagers

LoveUP is not directed to children. Use of the app must respect the minimum age applicable in app stores, local law, and platform-specific rules.

11. International data transfer

Some technology, infrastructure, payment, analytics, or support providers may operate outside Brazil. When international data transfers occur, we will seek to adopt measures compatible with applicable law.

12. Data subject rights

Under the LGPD, users may request confirmation of processing, access, correction, anonymization, blocking or deletion, portability, information about sharing, withdrawal of consent, objection, and deletion of personal data, subject to legal obligations and legitimate retention bases.
